GUELPH/ERAMOSA – An Ontario Land Tribunal (OLT) appeal on a huge refrigeration plant approved for Jones Baseline has been dropped.
Minus Forty had a 260,000 square foot refrigeration plant approved in fall of 2021 at 5063 Jones Baseline halfway between Guelph and Rockwood.
This was met with an outcry from nearby residents who formed an opposition group called Jones Baseline Community Group who filed an appeal with the OLT.
The group cited a decision from the former Township of Eramosa to designate the 28-acre property as future rural employment lands as ill-informed due to the residential growth in the area and led to rezoning.
A hearing date was set for Feb. 13 but this is no longer going forward.
An email from OLT case coordinator John Norris noted the scheduled hearing has been cancelled due to the withdrawal of the appeal.
A withdrawal letter from lawyer David Donnelly advised, "a settlement has now been reached between the Appellant and the Applicant, Jones Baseline Corp. The settlement resolves our client's appeal in is (sic) entirety. Base on this, the Appellant hereby withdraws its appeal."
Jon Pigozzo, opposition group member, confirmed the appeal has been dropped and the group is not moving forward with it
He said the Jones Baseline Community Group had entered into settlement discussions with Minus Forty to work on different ways to mitigate inconveniences on residents but declined to comment further at this time.
Requests for comment from Donnelly and Minus Forty officials were not immediately returned.
