Belwood murder trial: accused says he 'had no choice'

Kyle Gemin says it was an argument turned fatal and that he feared for his life in the incident that resulted in his grandfather's death

Kyle Gemin is led into Guelph Superior Court by officers for the first day of his second-degree murder trial.

"Maybe what I did wasn't really a homicide, maybe it was self-defence."

That was part of Kyle Gemin's statement to police just a couple of days after it's alleged he killed his grandfather at their Belwood home three years ago.

On Wednesday, video and audio was played in Guelph Superior Court, showing Gemin talking with police in an interview room. The interview took place in a couple parts on July 2, 2020, a day after 74-year-old George Gemin's body was found and the younger Gemin was arrested.

The recording, shown in front of the jury, revealed Gemin's account of what happened the night of June 30, and what he said was an argument that turned fatal for 74-year-old George Gemin at their home on Poplar Place in the Maple Leaf Acres trailer park.

Kyle told OPP Det. Sgt. Steve Coburn he "had no choice. I was afraid for my life."

He referenced a history of loud arguments between the two of them, and how he was afraid George would kill him.

On the night in question, Kyle told the officer George reached for a knife in a kitchen drawer. Feeling threatened, Kyle said he pushed his grandfather to the ground and the altercation ensued, which left the 74-year-old man dead.

He was also heard saying he doesn't know why he took off afterwards, and doesn't know why he didn't report George's death to police.

Other parts of the interview, Kyle makes other accounts, referencing his sleepwalking, and also questioning whether or not he was the guilty party altogether, claiming perhaps someone else entered the home that night.

It should be noted the video evidence presented is part of the Crown's case.

The defence is expected to present its case starting either Thursday or Friday.
